Article 6 — Supremacy and Hierarchy of Law

1. 1.

   The authority of the Nation and State is vested ultimately, personally and indivisibly in the Sovereign.

2. 2.

   A Sovereign Decree is the highest form of law in Kaharagia and constitutes an authoritative expression of the will and authority of the Sovereign.

3. 3.

   A Sovereign Decree shall prevail over the Fundamental Laws and Principles, every Code, Act, Regulation, rule, order, directive, custom, practice and other instrument to the extent of any inconsistency.

4. 4.

   The precedence of a Sovereign Decree shall not depend upon its expressly identifying, amending or repealing the inconsistent provision.

5. 5.

   Subject to Sovereign Decrees, the Fundamental Laws and Principles shall constitute the supreme general and constitutional law of Kaharagia.

6. 6.

   Every Code, Act, Regulation and other subordinate instrument shall be interpreted and applied consistently with the Fundamental Laws and Principles and with every applicable Sovereign Decree.

7. 7.

   No court, tribunal, officer, institution or organ of the Nation or State may invalidate, suspend or refuse legal effect to a Sovereign Decree on the ground that it is inconsistent with the Fundamental Laws and Principles or another subordinate instrument.

8. 8.

   A competent court or tribunal may determine the authenticity, interpretation, scope and application of a Sovereign Decree, but shall give effect to the Decree as the supreme expression of the authority of the Sovereign.
