Article XV — Exemptions and Alternative Compliance

   A General Regulation may authorise the responsible authority to grant an exemption, waiver, or alternative means of compliance.

   An exemption or alternative may be allowed where:

   1. strict compliance is impossible or impracticable;

   2. another method substantially fulfils the purpose of the Regulation;

   3. reasonable accommodation is required;

   4. the defect is immaterial; or

   5. strict application would produce a disproportionate result.

3. 3.

   A significant decision granting or refusing an exemption shall ordinarily be recorded with reasons.
