Article XV — Exemptions and Alternative Compliance

A General Regulation may authorise the responsible authority to grant an exemption, waiver, or alternative means of compliance.

An exemption or alternative may be allowed where:
strict compliance is impossible or impracticable;
another method substantially fulfils the purpose of the Regulation;
reasonable accommodation is required;
the defect is immaterial; or
strict application would produce a disproportionate result.

3.
A significant decision granting or refusing an exemption shall ordinarily be recorded with reasons.
