Article 37 — Acquisition, Transfer, and Loss of Ownership

  1. Ownership of movable property is acquired by creation, contract, succession, gift, prescription where recognised by the applicable law, or any other mode recognised by law.
  2. Transfer of ownership between parties takes effect by agreement. As against third parties, transfer takes effect according to the rules of the jurisdiction in which the property is situated or, for intangible property, from the date the transfer is recorded or notified as the law requires.
  3. No person may be deprived of property except for public purposes and upon fair compensation, or as otherwise provided by law.
  4. Ownership is lost by alienation, abandonment, destruction of the thing, or operation of law.
