The data subject shall have the right to obtain from the controller restriction of processing where one of the following applies:
The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
The processing is unlawful and the data subject opposes the erasure of the personal data pursuant to Article 12 and requests the restriction of their use instead.
The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise, or defence of legal claims.
The data subject has objected to processing pending the verification of whether the legitimate grounds of the controller override those of the data subject.
Where processing has been restricted under paragraph 1, such personal data shall, with the exception of storage, only be processed with the data subject's consent, or for the establishment, exercise, or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the Principality.
A data subject who has obtained restriction of processing pursuant to paragraph 1 shall be informed by the controller before the restriction of processing is lifted. The controller shall provide such notice within a reasonable period before lifting the restriction, affording the data subject the opportunity to take any further action in protection of his or her rights.
Where restriction of processing is applied, the controller shall clearly mark the data concerned to ensure that the restriction is respected across all systems and by all persons authorised to process data on behalf of the controller.
The controller shall communicate any restriction of processing carried out in accordance with paragraph 1 to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. The controller shall inform the data subject about those recipients if the data subject requests it.
The controller shall respond to a request for restriction without undue delay and in any event within thirty days of receipt of the request. Where the controller does not take action on the request, the controller shall inform the data subject without delay and at the latest within thirty days of receipt of the request of the reasons for not taking action and of the possibility of lodging a complaint with the competent supervisory authority and seeking a judicial remedy.
