Article 42 - Personal Jurisdiction

The laws of the State apply to its nationals and recognised legal persons wherever situated, subject to the mandatory law of the jurisdiction in which they are physically present.

Recognised legal persons include legal persons created under Kaharagian law and such foreign legal persons as are recognised by the Sovereign for specified purposes.

In the absence of territorial jurisdiction, the primary basis of Kaharagian jurisdiction is personal (nationality) and consensual (submission), as provided in this Title.

The exercise and enforcement of jurisdiction outside Kaharagia depends on practical capacity and on the laws of the place of enforcement.

The State may, by law, provide conflict-of-laws rules for determining applicable law in private matters.
